Very important notice regarding business registration with the Department of Commerce, Supplies and Consumer Protection for entrepreneurs selling their goods and services through e-commerce.

In order to regulate the commercial transactions of goods and services through information technology and make them systematic and reliable, the Electronic Commerce (E-Commerce) Act 2081 was published in the Nepal Gazette on Chaitra 3, 2081 and came into effect on Baisakh 2, 2082. According to this Act, entrepreneurs who were engaged in electronic commerce before the enactment of the Act must be mandatorily listed on the electronic commerce portal of the Department of Commerce, Supplies and Consumer Protection within three months from the date of enactment of this Act, and new entrepreneurs must be mandatorily listed to do business. Entrepreneurs who are engaged in electronic commerce and are starting a new business are requested to prepare their electronic platform with the details as per Sub-section (2) of Section 4 of the Act and submit an electronic application to be listed on the portal of this department along with an electronic copy of the documents as per Section 5 of the same Act.

Details to be mentioned on the electronic platform:

1. Name of electrical platform

2. Business name, address, registered entity and registration certificate number

3. Details of the registered office, head office, and branches and outlets where the business is conducted, if any.

4. Details of any separate permission obtained to operate a specific type of business

5. Details of which business to do, intermediary or list-based business

6. Value Added Tax Record Number or Permanent Account Number

7. Contact details for the business owner, including e-mail, telephone, mobile number, fax, social media address (link) and designated e-mail, telephone and mobile numbers for customer service.

8. Email, telephone or mobile number and address of the person responsible for hearing the complaint or the complaint unit

9. Listing No. received after being listed on the electronic trading portal.

Documents required for listing on the e-commerce portal:

1. Business name, address, registered entity registration certificate number

2. In the case of a businessperson registered in a private firm, the name and identity of the respective proprietor, in the case of a businessperson registered in a partnership firm, the name of the partner, and in the case of a company or organization, the name and identity of the director of the company or organization.

3. A clear description of the business by the entrepreneur

4. Value Added Tax Number or Standing Account Number

5. Telephone number, email, social media address (link) and contact address of the business owner

6. If there is a branch or outlet, its number and location

7. Other details mentioned in the electronic portal

Note :-

1. Businessmen currently engaged in electronic commerce must submit an application for mandatory listing by 2082/04/02, as per the provisions of the Act.
